Terms and Conditions
By signing and submitting this Incentive Agreement, I confirm that I have read and understand all Program documents including the Program Rules and agree to be bound by the Terms and Conditions listed in the Program Rules.
Utility Customer Commitments and Program Requirements
By signing and submitting this Incentive Agreement, Utility Customer confirms and agrees as follows:
  1. I meet the eligibility requirements and the electric account information provided in this Agreement will be the account that the new or existing PV system and new BESS will serve.
  2. I would like to participate in the Program and agree that the City will determine the incentive amount.
  3. Completing and submitting this Agreement is not a guarantee of Program participation.
  4. The undersigned is duly authorized to execute this Agreement and all information provided is true and correct and acknowledge that information found to be false or misleading is grounds to void this Incentive Agreement and reject or cancel the incentive reservation.
  5. Program incentives are available only if I execute an Incentive Claim Form, eligibility is established by the City, the incentivized project elements are installed and verified, and the completed project complies with all Program rules and requirements.
  6. I agree to implement and install the BESS as described in the Planned BESS Information section of this Incentive Agreement and in full compliance with all eligibility requirements in the Program Rules.
  7. I agree to cooperate in good faith with any evaluation or verification activities required by the City, including providing all documentation reasonably necessary for verification of installation and performance of the project, including but not limited to, manufacturer's specification sheets and installer and construction invoices.
  8. I will maintain the BESS in a daily cycling mode with the backup reserve state of charge at or below the percentage indicated in the Incentive Claim Form for the duration of its Useful Life. I understand that SFPUC may audit my electric usage and system data. I agree that if settings are changed in violation of Program Rules, the SFPUC may reclaim the incentive payment and I may be barred from future program eligibility. If an audit reveals that the BESS is used for back up only or settings were altered in violation of Program Rules, SFPUC may reclaim the incentive payment, issue a Notice of Program Violation, and deem me ineligible for future programs.
  9. For Third-Party Owned Systems, I attest that I will have the ability and authority to change BESS settings to meet Program requirements (daily cycling and backup reserve state of charge).
  10. I will promptly inform the Program team of any change in information, project scope, account information, installer information, or property ownership and understand that changes may result in the need to resubmit this Agreement.
  11. I will disclose and promptly notify the Program team regarding any BESS incentives I have applied for or have been offered by local agencies or other programs. I agree that the total incentives I have or will receive for the BESS must not exceed 100% of the total BESS project cost.

  13. If a property owner/manager is installing a BESS that will impact tenants, property owner/manager will inform tenants that they have applied for this BESS incentive Program and inform tenants of the incentive amount received from the Program after the project is complete.
